The court upheld a previous dismissal of a lawsuit that had been filed against these organizations, challenging the appropriateness of their education, awareness and advertising campaign on patient safety.

    The claim of the complainants was that the awareness campaign resulted in loss of business to non-plastic surgeons. The appellate court’s decision to uphold the dismissal of the appeal serves as a key legal victory for organized plastic surgery and the cause of patient safety. The victory also indirectly validates the public education campaign of the ASPS for patient safety called ‘Do Your Homework.’

    The conclusion of the Appeals Court was that the plaintiffs had failed to prove any violation on part of the defendants, ruled in favor of ASPS, ABPS, and others.

    Critical Distinction

    The UPSS President Brian Brzowski commented that the decision of the court confirms the significance of generating public awareness about the critical distinction between certified plastic surgeons and less trained surgeons who may present themselves as similarly skilled.
